Terms & Conditions
Booking Conditions
These Booking Conditions, together with our Privacy Policy and any other written information we provided to you, form the basis of your contract with Delphian Paths. By making a booking, the person whose name is first on the booking form (the "Lead Name") agrees on behalf of themselves and all other people on the booking that:
-
They have read these Booking Conditions and agree to be bound by them.
-
They consent to our use of personal data in accordance with our Privacy Policy and are authorized to disclose the personal details of all people named on the booking to us, including special categories of data where applicable (such as information on health conditions or disabilities and dietary requirements).
-
They are over 18 years of age and, when booking services with age restrictions, declare that they and all members of the party are of the appropriate age to purchase those services.
-
They accept financial responsibility for payment of the booking on behalf of all people named on the booking.
-
They have read and reviewed in full the website descriptions before making a reservation with payment.
Jurisdiction and Supplier Conditions
-
These T&Cs and any agreement to which they apply are governed by and construed in accordance with Greek law. You and we agree to submit to the exclusive jurisdiction of the courts of Greece.
-
You must obey the laws and regulations of Greece while on our tours. If you fail to do so, we may be released from all obligations to you.
-
Many of the services on our tours are provided by independent suppliers. These suppliers provide services in accordance with their own terms and conditions, which will become part of your contract with us. Some of these terms and conditions may limit or exclude the supplier's liability to you.
-
The specific itinerary, inclusions, and additional information for a tour are detailed in our website. If you participate in an activity that is not specifically listed as included you:
-
Accept full responsibility for taking part in such an activity.
-
Accept that we will not provide any further services, except for inclusion waiver activities.
-
Acknowledgement of Risk and Behavior
-
The tours we operate or supply are designed to give participants a real-world experience of the environment they are visiting. Most of them are conducted outdoors which means that they involve an element of risk and exposure to potential hazards (e.g. animal attacks, landslides, etc.). We are not liable for any risks, injuries or hazards.
-
Our tours require some level of active participation. You accept that the tours may include outdoor activities where events are less predictable than usual. A variety of factors, including weather and transportation difficulties, may require changes in any tour and activity. Only rarely will such changes be significant, and we will make every reasonable effort to minimize the impact of any necessary changes.
-
You agree to obey the authority and decisions of our employees, tour leaders, and agents while on tours with us. You are expected to conduct yourself in an orderly and acceptable manner and not to disrupt the enjoyment of others. If we or any tour guide, manager, or other person in authority (such as a driver or transportation official) believes that your behavior or the behavior of any member of your party is causing or is likely to cause damage, distress, danger, or annoyance to any other customers or any third party, we reserve the right to terminate your booking immediately. In the event of such termination, our liability to you and/or your party will cease, and you and/or your party will be required to leave the activity/tour or other arrangements immediately. We will have no further obligations to you and/or your party. No refunds will be made for any arrangements, and we will not pay any expenses or costs incurred as a result of termination under these circumstances. You and/or your party are jointly and individually liable for any misconduct (e.g. harmful behavior to other participants), loss or damage caused by your actions. Full payment for any such damage, losses or misconduct must be paid directly to the tour guide, other supplier or any other third party (incl. other group members). If you fail to make payment, you will be responsible for meeting any claims (including legal costs) subsequently made against us as a result of your actions, together with all costs incurred in pursuing any claim against you.
-
We cannot be held responsible for the actions or behavior of other participants (e.g. group members or third party providers) or individuals who have no connection with your booking arrangements or with us.
-
All bookings are accepted on the understanding that you appreciate such risks and hazards and that you undertake all tours at your own volition. We cannot be held liable for the results of changes or delays, regardless of how they are caused.
Accuracy and Pricing
-
We make every effort to ensure that all information and prices on our website and in any advertising materials we publish are accurate. However, changes and errors do occur occasionally, and we reserve the right to correct prices and other details in such circumstances.
-
We reserve the right to amend the price of unsold tours at any time and to correct errors in the prices of confirmed tours.
Booking and Paying for your Arrangements
-
A booking is secured when you pay in full or a non-refundable deposit. Some exceptions may apply to deposits for bookings secured with third-party operators. You will be notified of the exact deposit amount when you book, and it will be confirmed on your invoice.
-
All tours must be paid for in full before the start of the tour and are not eligible for refunds unless otherwise specified. We strongly recommend that you purchase travel insurance to cover unforeseen events when you book.
-
We have the right to return your payment and decline to issue a booking confirmation at our discretion. A binding contract between you and us will come into existence when we receive payment and issue you a written booking confirmation confirming the details of your booking. This will be sent to you or your travel agent.
-
Sightseeing entrance fees and local payments may be obligatory for many of our tours and are payable at the start of the tour. All prices are per person unless otherwise stated and details of these costs are listed on our website.
-
Money paid to an agent on our behalf for tours we operate is held by the agent on our behalf.
-
Online bookings: You will receive an email after booking online to confirm that your slot on our tour has been reserved. Online bookings are not confirmed until you receive a personalized email from a member of our reservation team confirming your booking. Payments will be made locally at the meeting point for the tour or directly to our suppliers before the start of the tour.
-
Sale or promotional prices:
-
Apply only to new bookings made during the promotional period.
-
Cannot be used in conjunction with any other offer or discount.
-
-
Free cancellation and amendments are available on all our tours when the booking is confirmed but not paid.
Special Requests
-
You must tell us about any special requests, such as dietary restrictions or special needs due to a disability or medical condition, at the time of booking. You must also confirm your requests in writing.
-
We will do our best to accommodate your reasonable special requests, but we cannot guarantee that they will be met. The fact that a special request has been noted or that it has been passed on to the supplier, does not mean that the request will be met.
-
If we cannot meet a special request, this is not a breach of contract on our part. We also do not accept bookings that are conditional on any special request being met.
Fitness and Medical Conditions
We want you and everyone in your booking group to enjoy your tour to the fullest. To make this possible, everyone must be able to fully participate in the activities of the tour. Please carefully consider whether you are physically and mentally able to complete the tour you have chosen. On most of our tours, you will need to carry your own bags, walk at a moderate pace, and be able to take care of yourself without your guide's supervision, both during free time and during the included activities and meals.
People with pre-existing medical conditions:
Please tell us in writing before you book if you need regular care from a doctor or have any medical or other conditions that we should be aware of.
You are responsible for deciding whether a tour or tailored arrangement is suitable for you. We do not provide medical advice. It is your responsibility to assess the risks and requirements of each part of the tour based on your own circumstances, limitations, fitness level, and medical needs.
If our team believes that a participant’s health or conduct before or after the start of the tour is likely to endanger the safe, comfortable, or enjoyable progress of the tour, the participant may be excluded from all or part of the tour. In this case, the participant will forfeit all money paid, and we will not be liable to pay any compensation to the participant.
To avoid this situation, please make sure you understand the level of fitness and ability required to complete the tour you are booking. It is your responsibility to tell us if you have any concerns about this. If you have any medical condition or disability you must give us full details at the time of booking.
If we accept your booking, you must make arrangements to provide yourself with any medication or other treatment you need during the tour.
Although there is no upper age limit for our tours, we cannot accept unaccompanied minors (i.e., those under 18 years of age) on tours we operate. Individuals below 18 years of age may participate provided they are accompanied by a parent or guardian who accepts full responsibility for them.
Insurance
To take part in a tour organized by us, you MUST purchase adequate and suitable insurance (incl. travel and/or health insurance). This is a condition of your contract with us. You are solely responsible for arranging your own insurance. However, we will not check this policy to make sure it is suitable for you. It remains your responsibility to ensure that you have adequate insurance at all times.
You should make sure that there are no exclusions in your policy that limit protection for the types of activities you will be doing with us. A suitable insurance policy should also provide adequate coverage for medical expenses arising from illness or accident before or during the tour and for losses of money due to cancellation or curtailment of the tour for reasons that are covered by insurance. You must be satisfied that your insurance fully covers all of your personal needs, including pre-existing medical conditions.
We have the right to cancel the booking of any customer who cannot prove to us that they have purchased suitable travel insurance in accordance with this clause, without any liability for refunds. Additionally, if you choose to participate without adequate insurance coverage, we will not be liable for any losses, however these arise.
Cancellation Policy
Cancellation by You
We kindly ask you to inform us in advance in case of any cancellations.
-
Bookings through our website: You can cancel your booking anytime before the start time of the tour however you are not entitled to a refund.
-
Bookings via third parties: Please visit your booking agent's cancellation policy.
Cancellation by Us
-
We aim to operate all tours as advertised, but we reserve the right to make changes or cancel your booking at any time. We will tell you as soon as possible if we have to make a significant change or cancel your tour.
-
Most of our tours and activities take place outdoors. We may have to cancel a tour prior to its start time due to bad weather or other unforeseen circumstances, such as the inability to replace our tour guide in case of sickness, unforeseen issues with the transport etc. In case of cancellation by us due to the above reasons, we will provide a full refund.
-
If we have to cancel your tour, we will offer you one of the following options:
-
Get a full refund
-
Join one of our alternative tours/activities of a comparable standard at no extra cost (subject to availability)
-
Important note
1. You will not be entitled to a refund if:
-
We make an insignificant change to the tour (e.g. change of meeting point)
-
You join one of our alternative tours/activities
-
We are forced to cancel or change your booking due to force majeure
2. Transferring your place to someone else
If you or someone in your party cannot participate in their activity, you may transfer their place to someone else, subject to the following conditions:
-
The person you introduce must satisfy all the conditions applicable to the tour.
-
You must pay any outstanding balance payment. You and the transferee remain jointly and severally liable for payment of all sums.
-
The transferee must agree to these booking conditions and all other terms of the contract between us.
If you are unable to find a replacement, our standard cancellation policy will apply in order to cover our estimated costs.
Please Note:
While in a group tour, you cannot choose to do something different from the planned itinerary, except during free time. If you do, you may miss the rest of your tour and not be entitled to any other services that are included in your booking. Our responsibility to you and your party will end at that point, and you will not be entitled to a refund or compensation.
Delays/No Shows
If you or anyone in your booking group does not arrive at the meeting point at least 10 minutes prior to the start of the tour, we have the right to refuse your participation and you will not be entitled to a refund. If you decide to cut your tour short, you will not be entitled to a refund and we will not be liable for any associated costs you may incur. Depending on the circumstances, your travel insurance may cover curtailment. It is your responsibility to contact your insurer at that time and get any receipts you need for your claim.
Force Majeure
We are not required to give you a full refund (we may give you a partial refund after deducting unrecoverable costs, such as deposits) or pay you compensation if our ability to fulfil our contractual obligations to you is affected by a "force majeure" event. For the purposes of these T&Cs, a force majeure event is any event beyond our or our suppliers' control that could not have been avoided even if we had taken all reasonable steps. Examples include: bad weather after the start of the tour, animal attacks, war, terrorism, civil unrest, serious health risks such as disease outbreaks, and natural disasters such as earthquakes. Check with your travel insurance provider, as you may be able to claim for these costs.
Assistance
We do our best to make sure your tour arrangements run smoothly, but if you have any problems during your activity, please let your tour guide know immediately.
If you get into difficulty for any reason during your activity, we will provide you with the appropriate help and support, depending on the circumstances. This may include giving you information about health services, local authorities, and consular assistance. If you need help that is not our fault, our employees' fault, or our subcontractors' fault, we will not be responsible for the cost of any arrangements or other assistance you might need. Subject to the other terms of these T&Cs, we will not be liable for any costs, fees, or charges you incur in the above circumstances. Additionally, we reserve the right to charge you a fee for our assistance if the difficulty was caused intentionally by you or a member of your party, or through your or your party's negligence.
If your tour guide is not available, please contact our team immediately. If our team is still unable to resolve the matter, please contact your booking consultant or our office. Please note that there may be a delay in our response.
Please note that privacy laws prevent us from commenting on any members of your booking party who are not present.
If you do not inform your guide or local team at the time or follow the procedure set out above, this will affect your rights under this contract.
